Please do not hesitate to contact Chicago Beauty Exchange at any time with your questions or concerns prior to use of this site, class registration, or sales transaction. Please read through the Chicago Beauty Exchange policies carefully before placing prior to using the site or registering for an educational event or class. By using this site, completing a sales transaction, or registering for an educational event or class with Chicago Beauty Exchange, you agree to be bound by these policies. SITE & BILLING TERMS - a. The term "CBE" refers to the Chicago Beauty Exchange, and its respective affiliated companies, partners, officers, agents, employees, and subcontractors. The terms "class" or "event" shall apply to any educational class, event, workshop, seminar, or camp offered by CBE "Student" refers to the registered person attending a class or event. "Purchaser" applies to the person(s) completing a sales transaction with CBE. "Transaction" shall apply to any attempted or completed sale for product, class materials, event ticket, or class registration. "Product" applies to any kit, materials, print or digital documents required to be purchased directly from CBE for an educational event or class. The term "site" refers to the Chicago Beauty Exchange website, its online store, as well as any third party websites or social media profiles registered in its name. The term "site user" refers to any visitor, guest, or viewer accessing the Chicago Beauty Exchange website, online store, or any third party websites or social media profiles registered in its name. b. CBE may change these terms from time to time without notice to site. Changes will apply to any subsequent scheduled appointments and/or orders received. In addition, your use of this Website after such changes have been posted constitutes your acceptance of and agreement to such changes. C. These terms and conditions are applicable to the site user upon accessing the site, as well as to the student upon completing the registration or transaction process. These terms and conditions, or any part of them, may be terminated by CBE without notice at any time and for any reason. The provisions relating to Copyrights, Trademark shall survive any termination. If any provision or provisions of this Agreement shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. SITE USE - Use of the CBE site shall be governed in all respects by the laws of the state of Illinois, U.S.A., without regard to choice of law provisions, and the student agrees that the United Nations Convention on Contracts for the International Sale of Goods will not apply to any sales transaction or moneys paid to CBE. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of products) shall be in the state or federal courts located in Cook County, Illinois. Any cause of action or claim the student may have with respect to the site (including but not limited to the purchase of products) must be commenced within 6 months after the claim or cause of action arises. ‘CBE's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the student and CBE, nor trade practice shall act to modify any of these terms and conditions. CBE may assign its rights and duties under this Agreement to any party at any time without notice to the student. PAYMENT METHODS - Unless other arrangements have been confirmed in writing, all payments are to be received in full at least one week prior to the class/event date. Acceptable forms of payment include credit card, cash, or checks. Checks must be received and fully funded FOUR WEEKS prior to the event or class in order to confirm student registration or ticket purchase. Cash may only be used as payment for classes, seminars, camps, or workshops with a prior written request by the Purchaser, and expressed prior written confirmation from CBE. MATERIAL & CLASS FEES - a. All required materials specified in a class description or syllabus must be present for use during the class. Product substitutions permitted only with prior written authorization. b. Failure to have the specified materials at the time of the class, may mean that the student will not be able to participate in the affected exercises, and will not receive the full experience of the program. Only students with the specified and sanitary tools and materials will be permitted to participate in the class or event. c. All materials and product sales are final. No unclaimed or discarded product purchases are to be applied towards a future class/material as a credit. d. All purchased class materials must be claimed and picked up from CBE more than 4 weeks after the class/event has completed. If the purchased item(s) are not claimed within 4 weeks after the class/event, the item(s) will be deemed as discarded, and the student will forfeit any claim to the item(s). e. The student will be responsible for all product and materials shipping/pick up arrangements, as well as any shipping/handling costs required to receive the purchased products and materials within the 4 week window after the class/event. f. In the event that a product or class is mistakenly listed with the incorrect wording,CBE has the final say on what is included in a class kit, online or digital documents, class, or event. In the event that a product or class is mistakenly listed with the incorrect price, CBE reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Any money's paid will be subject to the CBE terms of cancellation. DISCOUNTS - a. If a student/attendee does not qualify for the discount amount applied to his or her transaction, any monies paid will be applied towards the total amount due, and payment is subject to the terms of service and/or cancellation policy. If registering for a reduced rate for attending two, same day classes, both classes must be purchased during the same transaction for the discount to apply. If the student fails to purchase the two, same day classes during the same transaction, the student will not be registered for either class, and any payment received by CBE will the total amount due, and any moneys received are subject to the terms of service and/or cancellation policy. b. Proof of industry, student, or discount qualifications may need to be verified to confirm registration. c. Only one discount may be used at a time, and they may not be combined, unless stated otherwise. d. If receiving a discount based on membership with a specified group, school, or affiliation, please submit documentation of the current, up to date membership. Current membership documentation should be emailed to firstname.lastname@example.org or presented to the teacher prior to the start of class. Acceptable forms of documentation are: photograph of the current student ID/membership card with future expiration date, proof of current semester registration, receipt of professional membership dues paid with payment date, or dated letter from school/membership group. CANCELLATIONS - a. If the purchaser will not be the one attending a class, that purchaser must note the student's name at the time of registration and payment for any class and/or kit fees. Any monies paid toward a class, kit, or event are non-refundable. Such payments are not transferable, unless given expressed written permission by CBE. b. Regardless of the reason for missing the specified class/event, there are no refunds for a class the student fails to attend, including for reasons such as but not limited to: severe weather, lack of transportation, job loss, medical emergency, or Acts of God. The student's failure to attend the specified class/event will result in a credit in the student's name in the amount paid, good only for 6 months towards the attendance of a future events, kits, or classes. CBE must receive and confirm written notice 24 hours prior that the student(s) will be unable to attend class. Failure on the student's behalf to apply the class credit to a future class within 6 months time from the missed class date will result in the forfeiture of the class credit and any moneys paid. c. If a transaction has been completed, no refunds will be processed if CBE has fulfilled its commitment in providing the product or service purchased. CBE is the final deciding factor on when a transaction has been completed. Once the student has paid in full for product or attended a class or event, the student's purchase has been completed in full. REFUSAL OF SERVICE & DISRUPTIVE BEHAVIOR - a. Any behavior or communication deemed disruptive, harassing, or harmful by CBE, its teachers, guests, or fellow attendees/students by another attendee/student may result in said attendee/student being escorted from the premises, and forfeiting any monies paid for events and classes. Forfeiture of monies paid due to disruptive/harmful behavior or communication will not be credited towards any future events or classes, and the attendee or student may be barred from attending future events or classes due to stated previous disruptive or harmful behavior or communication. b. CBE reserves the right to refuse any future orders or transactions without notice. LIMITATION OF LIABILITY - Where permitted by jurisdiction, and applicable by law, CBE shall not be liable for any special or consequential damages that result from the use of, performance or, or the inability to use, the CBE site(s), its products or classes, even if it has been advised of the possibility of such damages. INDEMNIFICATION - A. To the fullest extent permitted by law, the student shall indemnify CBE, and its respective affiliated companies, partners, officers, agents, employees, and subcontractors against and from any and all liabilities, claims, judgments, losses, orders, awards, damages, expenses, reasonable costs, fines, penalties, costs of defense, and reasonable attorneys’ fees (collectively, “Liabilities”) to the extent they arise directly or indirectly from or in connection with: (a) the actual or alleged fault or negligence of CBE, its officers, employees, agents, subcontractors, guests, invitees and/or representatives; (b) the use of the premises in connection for the Event under this Agreement. Such Liabilities shall include, but not be limited to, those which are attributable to personal injury, sickness, disease or death; and/or result from injury to or destruction of real or personal properties. B. The payment by the student to any indemnified party shall not affect, relieve or reduce the student's indemnification. This Section survives completion of the services or the termination of this agreement. The student herby agrees to compensate CBE for any personal injury to the CBE, its agents, employees, and subcontractors, and any damage to CBE's or subcontractors' equipment at the Location Site on the Event Date, provided the loss or damage was caused by the student or guest(s) of the student. COPYRIGHT - The site layout, text, and class and event titles and descriptions included on the CBE site(s), including but not limited to text and/or images copyrighted as a collective work under the United States and other copyright laws, and is the property of CBE. The collective work includes works that are licensed to CBE as of Copyright 2014 with all rights reserved. The student may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the site(s) solely for the student's own non-commercial use, to register for a class or event, or to purchase products. The student is not allowed to reproduce and/or redistribute any parts from this website, nor CBE print or digital materials in anyway shape nor form. Any other use, including but not limited to the reproduction, distribution, display or transmission of the CBE content or its online site is strictly prohibited, unless with prior written authorization by CBE. The student further agrees not to change or delete any proprietary notices from the materials downloaded from the CBE site. TRADEMARK - All trademarks, service marks and trade names of used in the site are trademarks or registered trademarks of CBE.
